Tennessee’s health care liability damages statute at TCA 29-26-119 was long thought to limit recoverable damages to medical bills actually paid or payable by some source. That changed—at least for cases involving privately purchased insurance—with the Tennessee Supreme Court’s decision in Crotty v. Flora in September 2023. Crotty was followed in May 2024 by enactment of an amended version of TCA 29-26-119 (the “Crotty fix”), which sought to restore the prior status quo. This webinar will address the application of Crotty and its legislative “fix,” as well as challenges to the retroactive application of both the case and amended statute.
