On March 11, 2016 the Court of Appeals for the Western Section issued an opinion in Jones v. Windham, 2016 Tenn App LEXIS 182 (Tenn Ct App March 11, 2016).  In a matter for first impression the Court of Appeals decided in a 2-1 decision not to adopt as the law in Tennessee the rule of preemption in cases involving claims for both vicarious liability and independent claims of negligence against the principal.  This is a significant decision that effects numerous types of cases in varying areas of law.  This webinar will discuss the issues presented in the case.  The two rules that the Court of Appeals considered and the policy arguments for both and its implications on these types of cases going forward.
